We have a strong pipeline of new business opportunities and plans to grow quickly. To support this growth we are looking to appoint an exceptional individual to lead our commercial function, reporting to the Finance Director.

Purpose of role: Responsible for all aspects of commercial activity within the business. This role will be responsible for delivering commercial solutions for new business opportunities, negotiating terms and conditions with customers and supporting M&A activities, as well as identifying/managing commercial risks in existing contracts and mitigating a number of legacy commercial issues.

Person specification

Key Accountabilities:

  • Managing existing customer contracts including negotiating amendments and extensions
  • Developing commercial solutions for new bids
  • Evaluating draft contracts and then negotiating terms and conditions and assessing risk against return
  • Negotiating Settlements and leading compromise negotiations, including arbitration, adjudication and litigation
  • Drafting and amending contracts, subcontracts, JV agreements, licences and other business agreements in relation to each of the above key tasks and activities
  • Management of in house legal counsel and external lawyers
  • Coordinating and providing due diligence support to M&A activities
  • Overseeing risk management and compliance processes for the business unit
  • Management of legal cases and claims
  • Managing and maintaining contract documentation, and ensuring that changes agreed with customers are incorporated into contract amendments
  • Developing standardised commercial processes

Qualifications

  • Degree educated
  • Relevant legal qualification desirable
  • Demonstrable commercial experience at a senior level
